NOTE:  A Book of Authorities containing the two cases  cited above was filed with the Justices of the Peace Review Council today in support of my client's motion seeking leave to reply to Presenting Counsel's submissions on compensation.  At Presenting Counsel's urging the Hearing Panel departed from the traditional public hearing format. People in the community who would traditionally have the right to attend and observe these important proceedings can not. This piece is published here as a public service. Justice must be seen to be done. The two legal authorities articulate the fundamental principle that personal, inflammatory and prejudicial comments by a Crown Counsel or in this case a Presenting Counsel can render a legal proceeding unfair and subject to being set aside
